To benefit from legal protection, employees who are pregnant, postpartum, or nursing must inform their employer in writing, accompanied by a medical document.<\/p><p>Once informed, the employer must promptly conduct a risk assessment with the occupational health physician to identify any specific risks to the employee. The findings must be documented and communicated to the employee. If risks are identified, the employer must temporarily adjust the working conditions or schedule to avoid exposure to these risks. If adjustments are not feasible, the employer must assign the employee to a different, risk-free position. If reassignment is also not possible, the employee is entitled to maternity risk leave.<\/p><p>Odat\u0103 informat, angajatorul are obliga\u021bia de \u00eentocmi \u00een cel mai scurt timp, cu participarea obligatorie a medicului de medicina muncii o evaluare a activit\u0103\u021bilor care pot prezenta un risc specific pentru salariata \u00een cauz\u0103 iar ulterior s\u0103 dispun\u0103 m\u0103suri adecvate privind natura, gradul \u0219i durata expunerii salariatei la astfel de activit\u0103\u021bi. Con\u021binutul acestei evalu\u0103ri trebuie consemnat \u00een scris \u0219i adus la cuno\u0219tin\u021ba salariatei \u00een cauz\u0103.<\/p><p>\u00cen m\u0103sura \u00een care \u00een urma acestei evalu\u0103ri sunt identificate unul sau mai multe riscuri pentru securitatea sau s\u0103n\u0103tatea salariatei \u00een cauz\u0103, angajatorul are obliga\u021bia general\u0103 de a adapta temporar condi\u021biile de munc\u0103 sau programul de lucru al salariatei astfel \u00eenc\u00e2t s\u0103 fie evitat\u0103 expunerea acesteia la riscurile eviden\u021biate. Dac\u0103 din motive bine \u00eentemeiate, aceste modific\u0103ri nu sunt posibile, angajatorul are obliga\u021bia de a-i schimba cu totul felul muncii, adic\u0103 de a-i oferi salariatei temporar un alt post f\u0103r\u0103 riscuri pentru s\u0103n\u0103tatea acesteia.<\/p><p>Dac\u0103 nici varianta aloc\u0103rii unui alt post nu este posibil\u0103, atunci salariata are dreptul la un concediu de risc maternal. Durata maxim\u0103 a concediului de risc maternal este de 120 de zile, iar acesta poate fi acordat \u00een \u00eentregime ori frac\u021bionat dup\u0103 cum urmeaz\u0103: fie \u00eenainte de concediul de maternitate, fie dup\u0103 concediul de l\u0103uzie, dac\u0103 nu se solicit\u0103 concediul pentru cre\u0219terea \u0219i \u00eengrijirea copilului.<\/p><p>Alte drepturi specifice salariatelor gravide, l\u0103uze ori care al\u0103pteaz\u0103:<\/p><ul><li><p>Dreptul la pauze \u0219i amenaj\u0103ri pentru repaus \u00een pozi\u021bie \u0219ez\u00e2nd\u0103 sau, respectiv, pentru mi\u0219care, la intervale regulate de timp<\/p><\/li><li><p>Reducerea duratei normale de munc\u0103 cu o p\u0103trime \u00een baza recomand\u0103rii medicului de familie<\/p><\/li><li><p>dispens\u0103 pentru consulta\u021bii prenatale \u00een limita a maximum 16 ore pe lun\u0103 f\u0103r\u0103 diminuarea drepturilor salariale<\/p><\/li><li><p>concediul de l\u0103uzie de minimum 42 de zile (at\u00e2t un drept c\u00e2t \u0219i o obliga\u021bie)<\/p><\/li><li><p>dou\u0103 pauze pentru al\u0103ptare de c\u00e2te o or\u0103 fiecare \u00een timpul programului de lucru p\u00e2n\u0103 la \u00eemplinirea v\u00e2rstei de un an a copilului. La cerere, pauzele pentru al\u0103ptare vor fi \u00eenlocuite cu reducerea duratei normale a timpului de munc\u0103 cu doua ore zilnic.<\/p><\/li><li><p>Dreptul de a nu presta munc\u0103 de noapte<\/p><\/li><li><p>Dreptul de a nu desf\u0103\u0219ura munc\u0103 \u00een condi\u021bii cu caracter insalubru sau greu de suportat.<\/p><\/li><li><p><em>Dreptul de a nu fi concediat\u0103 din motive care au leg\u0103tur\u0103 direct\u0103 cu starea sa.<\/em><\/p><\/li><li><p><em>Dreptul de a nu i se \u00eenceta raportul de munc\u0103 pe perioada concediului de risc maternal (+ 6 luni dup\u0103 revenire), a concediului de maternitate, a concediului de cre\u0219tere a copilului ori a pl\u0103\u021bii stimulentului de inser\u021bie.<\/em><\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>Protec\u021bia
