De la aceast\u0103 regul\u0103 se poate \u00eens\u0103 deroga \u0219i se poate \u00eencheia un contract individual de munc\u0103 pe durat\u0103 determinat\u0103 doar \u00een condi\u021biile expres \u0219i limitativ prev\u0103zute de lege.<\/p>\n<p>Astfel, cazurile \u00een care legea permite \u00eencheierea unui contract individual de munc\u0103 pe durat\u0103 determinat\u0103 sunt \u00een num\u0103r de 8, acestea fiind prev\u0103zute de\u00a0<strong>art. 83 din Codul Muncii<\/strong>.<\/p>\n<ul>\n<li>a) \u00eenlocuirea unui salariat \u00een cazul suspend\u0103rii contractului s\u0103u de munc\u0103, cu excep\u021bia situa\u021biei \u00een care acel salariat particip\u0103 la grev\u0103;<\/li>\n<li>b) cre\u0219terea \u0219i\/sau modificarea temporar\u0103 a structurii activit\u0103\u021bii angajatorului;<\/li>\n<li>c) desf\u0103\u0219urarea unor activit\u0103\u021bi cu caracter sezonier;<\/li>\n<li>d) \u00een situa\u021bia \u00een care este \u00eencheiat \u00een temeiul unor dispozi\u021bii legale emise cu scopul de a favoriza temporar anumite categorii de persoane f\u0103r\u0103 loc de munc\u0103;<\/li>\n<li>e) angajarea unei persoane care, \u00een termen de 5 ani de la data angaj\u0103rii, \u00eendepline\u0219te condi\u021biile de pensionare pentru limit\u0103 de v\u00e2rst\u0103;<\/li>\n<li>f) ocuparea unei func\u021bii eligibile \u00een cadrul organiza\u021biilor sindicale, patronale sau al organiza\u021biilor neguvernamentale, pe perioada mandatului;<\/li>\n<li>g) angajarea pensionarilor care, \u00een condi\u021biile legii, pot cumula pensia cu salariul;<\/li>\n<li>h) \u00een alte cazuri prev\u0103zute expres de legi speciale ori pentru desf\u0103\u0219urarea unor lucr\u0103ri, proiecte sau programe.<\/li>\n<\/ul>\n<p>Fiind vorba de o varietate a contractului individual de munc\u0103, acesta trebuie s\u0103 \u00eembrace forma scris\u0103 \u00een mod obligatoriu \u0219i trebuie s\u0103 cuprind\u0103, de asemenea, \u00een mod expres, durata pentru care se \u00eencheie.<\/p>\n<p>Pe durata execut\u0103rii contractului individual de munc\u0103, salaria\u021bii cu contract pe durat\u0103 determinat\u0103 beneficiaz\u0103 de toate drepturile prev\u0103zute \u00een legisla\u021bia muncii, \u00een contractul colectiv de munc\u0103 aplicabil, \u00een regulamentul intern, precum \u0219i \u00een contractul individual de munc\u0103, angajatorul av\u00e2nd obliga\u021bia de a nu face nicio diferen\u021biere de tratament fa\u021b\u0103 de salaria\u021bii \u00eencadra\u021bi cu contract pe durata nedeterminat\u0103, cu excep\u021bia cazurilor \u00een care tratamentul diferit este justificat de motive obiective.<\/p>\n<p>Contractul individual de munc\u0103 pe durat\u0103 determinat\u0103 poate fi \u00eencheiat pe o perioad\u0103 de cel mult 36 de luni.<\/p>\n<p>La data expir\u0103rii termenului contractului individual de munc\u0103 \u00eencheiat pe durat\u0103 determinat\u0103 acesta \u00eenceteaz\u0103 de drept. Totu\u0219i p\u0103r\u021bile prin acordul scris, pot decide prelungirea acestuia de cel mult dou\u0103 ori (maxim 3 contracte individuale de munc\u0103 succesive pe durat\u0103 determinat\u0103 \u00eentre acelea\u0219i p\u0103r\u021bi) pentru perioada realiz\u0103rii unui proiect, program sau unei lucr\u0103ri, f\u0103r\u0103 \u00eens\u0103 a se dep\u0103\u0219i durata maxim\u0103 de 36 de luni.<\/p>\n<p>De asemenea, o excep\u021bie de la regula potrivit c\u0103reia contractul individual de munc\u0103 pe durat\u0103 determinat\u0103 \u00eenceteaz\u0103 la momentul expir\u0103rii termenului pentru care a fost \u00eencheiat, este dat\u0103 de situa\u021bia \u00eenlocuirii unui salariat al c\u0103rui contract de munc\u0103 este suspendat.<\/p>\n<p>Astfel, la momentul \u00eencet\u0103rii motivelor ce au determinat suspendarea contractului individual de munc\u0103 al salariatului titular, contractul individual de munc\u0103 pe durat\u0103 determinat\u0103 va \u00eenceta de drept.<\/p>\n<p>Nu \u00een ultimul r\u00e2nd, salaria\u021bii \u00eencadra\u021bi cu contract individual de munc\u0103 pe durat\u0103 determinat\u0103 pot fi supu\u0219i unei perioade de prob\u0103 a c\u0103rei durat\u0103 maxim\u0103 legiuitorul a stabilit-o \u00een mod corect sub limitele perioadei de prob\u0103 pentru salaria\u021bii cu contract individual de munc\u0103 pe durat\u0103 nedeterminat\u0103, dup\u0103 cum urmeaz\u0103:<\/p>\n<ul>\n<li>a) 5 zile lucr\u0103toare pentru o durat\u0103 a contractului individual de munc\u0103 mai mic\u0103 de 3 luni;<\/li>\n<li>b) 15 zile lucr\u0103toare pentru o durat\u0103 a contractului individual de munc\u0103 cuprins\u0103 \u00eentre 3 \u0219i 6 luni;<\/li>\n<li>c) 30 de zile lucr\u0103toare pentru o durat\u0103 a contractului individual de munc\u0103 mai mare de 6 luni;<\/li>\n<li>d) 45 de zile lucr\u0103toare \u00een cazul salaria\u021bilor \u00eencadra\u021bi \u00een func\u021bii de conducere, pentru o durat\u0103 a contractului individual de munc\u0103 mai mare de 6 luni.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Ca regul\u0103, contractele individuale de munc\u0103 se \u00eencheie pe durat\u0103 nedeterminat\u0103.
