\u00eent\u00e2lnit\u0103 \u00een via\u021ba de zi cu zi, \u00een special \u00een mediul rural este de\u021binerea unor imobile f\u0103r\u0103 titlu de proprietate (f\u0103r\u0103 acte legale), de\u0219i persoana care posed\u0103 respectivul imobil s-a comportat ca un adev\u0103rat proprietar o perioad\u0103 \u00eendelungat\u0103 \u0219i posesia nu i-a fost tulburat\u0103 de nicio alt\u0103 persoan\u0103 care s\u0103 pretind\u0103 vreun drept asupra imobilului.<\/p><p>Cauzele unor astfel de situa\u021bii pot fi diverse: dob\u00e2ndirea imobilului printr-un \u00eenscris sub semn\u0103tur\u0103 privat\u0103 (c\u00e2nd legea permitea acest lucru) ori nefinalizarea unor proceduri succesorale foarte vechi.<\/p><p>Pentru a putea fi proprietar \u00een sensul legii \u0219i pentru a putea dispune din punct de vedere juridic de un imobil aflat \u00eentr-o astfel de situa\u021bie, cel \u00eendrept\u0103\u021bit are la \u00eendem\u00e2n\u0103 calea judiciar\u0103 prin procedura uzucapiunii dac\u0103 sunt \u00eendeplinite c\u00e2teva condi\u021bii legale.<\/p><p>Potrivit dispozi\u021biilor legale incidente (art. 931 \u2013 934 Cod Civil) uzucapiunea poate fi de dou\u0103 feluri: tabular\u0103 \u0219i extratabular\u0103.<\/p><p>Uzucapiunea extratabular\u0103 permite dob\u00e2ndirea dreptului de proprietate asupra unui imobil \u0219i a dezmembr\u0103mintelor sale prin posesia continu\u0103 timp de 10 ani, \u00een cazurile \u00een care imobilul nu este \u00eenscris \u00een nicio carte funciar\u0103 sau \u00een situa\u021bii precum decesul proprietarului \u00eenregistrat sau renun\u021barea la proprietate.<\/p><p>De cealalt\u0103 parte, uzucapiunea tabular\u0103 se refer\u0103 la dob\u00e2ndirea dreptului de proprietate de c\u0103tre cel care a fost \u00eenscris \u00een cartea funciar\u0103, f\u0103r\u0103 cauz\u0103 legitim\u0103, \u00een cazul \u00een care acesta a posedat imobilul timp de 5 ani dup\u0103 \u00eenregistrarea cererii de \u00eenscriere \u0219i a manifestat buna-credin\u021b\u0103.<\/p><p>\u00cen cazul uzucapiunii extratabulare (cea care este cel mai des \u00eent\u00e2lnit\u0103 \u00een practic\u0103), termenul uzucapiunii \u00eencepe s\u0103 curg\u0103 din momentul \u00een care imobilul posedat a r\u0103mas f\u0103r\u0103 proprietar, respectiv proprietarul a decedat, \u0219i-a \u00eencetat existen\u021ba sau a renun\u021bat la dreptul s\u0103u de proprietate, chiar dac\u0103 posesia celui care invoc\u0103 uzucapiunea a \u00eenceput anterior.<\/p><p>O chestiune oarecum complicat\u0103 \u00een practic\u0103 este indicarea numelui \u0219i domiciliului p\u00e2r\u00e2tului sau p\u00e2r\u00e2\u021bilor. Legea impune ca cererea de chemare \u00een judecat\u0103 s\u0103 fie f\u0103cut\u0103 \u00een contradictoriu cu fostul proprietar \u0219i pentru c\u0103 \u00een practic\u0103 poate fi vorba de posesie \u00eendelungat\u0103 \u00eentins\u0103 chiar pe mai multe genera\u021bii, identificarea fostului proprietar poate fi o adev\u0103rat\u0103 provocare.<\/p><p>\u00cen ce prive\u0219te actele necesare deschiderii unui proces de uzucapiune,\u00a0<strong>art. 1.051 alin. (3)<\/strong>\u00a0din Codul de procedur\u0103 civil\u0103 enumer\u0103 urm\u0103toarele:<\/p><p>a) un certificat eliberat de serviciul public comunitar local de eviden\u021b\u0103 a persoanelor, care atest\u0103 c\u0103 titularul dreptului \u00eenscris \u00een cartea funciar\u0103 este decedat, precum \u0219i data decesului sau, dup\u0103 caz, un certificat emis de autoritatea competent\u0103, care atest\u0103 faptul c\u0103 persoana juridic\u0103 titular\u0103 a dreptului \u00eenscris \u00een cartea funciar\u0103 \u0219i-a \u00eencetat existen\u021ba;<\/p><p>b) un certificat eliberat de camera notarilor publici, din care s\u0103 rezulte faptul dac\u0103 mo\u0219tenirea titularului \u00eenscris \u00een cartea funciar\u0103 a fost sau nu dezb\u0103tut\u0103, iar \u00een caz afirmativ, care sunt persoanele care au cules mo\u0219tenirea respectiv\u0103;<\/p><p>c) un certificat eliberat de prim\u0103ria \u00een a c\u0103rei raz\u0103 teritorial\u0103 este situat imobilul, din care s\u0103 rezulte c\u0103 acesta nu face parte din domeniul public al statului sau al unit\u0103\u021bii administrativ-teritoriale;<\/p><p>d) certificatul de rol fiscal, atunci c\u00e2nd este cazul;<\/p><p>e) \u00eenscrisul constatator al actului juridic pe care solicitantul \u0219i-a \u00eentemeiat posesia, atunci c\u00e2nd este cazul;<\/p><p>f) documenta\u021bia tehnic\u0103 cadastral\u0103 a imobilului, realizat\u0103, pe cheltuiala celui interesat, de o persoan\u0103 fizic\u0103 sau juridic\u0103 autorizat\u0103, potrivit legii;<\/p><p>g) extrasul de carte funciar\u0103 pentru informare, cu ar\u0103tarea titularului \u00eenscris \u00een cartea funciar\u0103 ori a \u00eenscrierii declara\u021biei de renun\u021bare la proprietate, precum \u0219i a faptului dac\u0103 imobilul este sau nu grevat de sarcini, eliberat de biroul teritorial de cadastru \u0219i publicitate imobiliar\u0103; \u00een cazul \u00een care imobilul nu este \u00eenscris \u00een cartea funciar\u0103 \u00een folosul altei persoane \u0219i nici grevat de sarcini, un certificat emis de acela\u0219i birou, care atest\u0103 acest fapt, inclusiv faptul c\u0103 nu a fost alocat un num\u0103r cadastral pentru \u00eenscrierea imobilului;<\/p><p>h) lista cuprinz\u00e2nd numele, prenumele \u0219i domiciliul a cel pu\u021bin 2 martori.<\/p><p><strong>\u00cen concluzie, av\u00e2nd \u00een vedere complexitatea \u0219i importan\u021ba uzucapiunii imobiliare, este recomandabil s\u0103 consulta\u021bi un avocat specializat \u00een dreptul imobiliar pentru a v\u0103 asigura c\u0103 \u00een\u021belege\u021bi \u00een mod corespunz\u0103tor implica\u021biile legale \u0219i procedurile aplicabile \u00een situa\u021bia dumneavoastr\u0103 specific\u0103. Acesta v\u0103 poate oferi sfaturi juridice personalizate \u0219i v\u0103 poate ghida \u00een demersurile necesare pentru protejarea \u0219i afirmarea drepturilor dumneavoastr\u0103 \u00een conformitate cu prevederile legale.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>O situa\u021bie
