Pentru a veni \u00een sprijinul lor, legiuitorul a stabilit c\u00e2teva drepturi pentru ace\u0219tia \u0219i totodat\u0103 o serie de obliga\u021bii pentru angajatorii lor.<\/p><p>Cea mai important\u0103 prevedere \u00een acest sens este interdic\u021bia dispunerii \u00eencet\u0103rii raporturilor de munc\u0103 de c\u0103tre angajator at\u00e2t pe durata concediului de cre\u0219tere a copilului, c\u00e2t \u0219i pe \u00eentreaga perioad\u0103 \u00een care primesc stimulentul de inser\u021bie, adic\u0103\u00a0<em>1 an de la \u00eentoarcerea la locul de munc\u0103<\/em>. Aceast\u0103 interdic\u021bie nu se aplic\u0103 \u00een cazul reorganiz\u0103rii judiciare sau a falimentului angajatorului.<\/p><p>Totodat\u0103, trebuie \u0219tiut faptul c\u0103\u00a0<em>salariatul are dreptul de a alege momentul \u00eentoarcerii la locul de munc\u0103<\/em>, \u00eens\u0103 are obliga\u021bia de a anun\u021ba, \u00een scris, angajatorul cu cel pu\u021bin 30 de zile \u00eenainte inten\u021bia de reluare a raportului de munc\u0103. Odat\u0103 anun\u021bat despre inten\u021bia salariatului, angajatorul este obligat s\u0103 faciliteze \u00eentoarcerea acestuia la munc\u0103, iar \u00een cazul \u00een care restric\u021bioneaz\u0103 ori condi\u021bioneaz\u0103 \u00een vreun fel reluarea raportului de munc\u0103 acesta s\u0103v\u00e2r\u0219e\u0219te o contraven\u021bie ce poate fi sanc\u021bionat\u0103 cu amend\u0103 cuprins\u0103 \u00eentre 5.000 \u0219i 10.000 de lei.<\/p><p>\u00centoarcerea la locul de munc\u0103 trebuie s\u0103 se fac\u0103 pe acela\u0219i post pe care l-a ocupat salariatul la momentul \u00eenceperii concediului de cre\u0219tere a copilului. Mai mult dec\u00e2t at\u00e2t, la momentul \u00eentoarcerii, salariatul trebuie s\u0103 beneficieze de toate \u00eembun\u0103t\u0103\u021birile aduse condi\u021biilor de munc\u0103 la care ar fi avut dreptul dac\u0103 nu ar fi efectuat concediul ori \u00een situa\u021bia \u00een care aceste condi\u021bii s-au \u00eenr\u0103ut\u0103\u021bit are dreptul s\u0103 beneficieze de cele mai favorabile existente anterior efectu\u0103rii concediului de cre\u0219tere a copilului.<\/p><p>Nu \u00een ultimul r\u00e2nd, tot ca o punere \u00een aplicare a principiului egalit\u0103\u021bii de \u0219anse, legiuitorul a stabilit faptul c\u0103\u00a0<em>orice drept \u00een leg\u0103tur\u0103 cu locul de munc\u0103 dob\u00e2ndit de salariat anterior \u00eenceperii concediului de cre\u0219tere a copilului sau care se afl\u0103 \u00een curs de a fi dob\u00e2ndit la data \u00eenceperii concediului de cre\u0219tere a copilului se men\u021bine pe toat\u0103 durata concediului \u0219i se aplic\u0103 \u0219i dup\u0103 \u00eencetarea acestuia, conform condi\u021biilor prev\u0103zute \u00een lege, contractul colectiv de munc\u0103 sau contractul individual de munc\u0103.<\/em><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Re\u00eenceperea
