Astfel, potrivit Codului Muncii, timpul de munc\u0103 al unui salariat nu poate dep\u0103\u0219i 48 de ore pe s\u0103pt\u0103m\u00e2n\u0103. Prin excep\u021bie, pot exista situa\u021bii negociate ori impuse din motive obiective ce \u021bin de organizarea muncii, \u00een care durata maxim\u0103 de 48 de ore pe s\u0103pt\u0103m\u00e2n\u0103 s\u0103 fie dep\u0103\u0219it\u0103 cu condi\u021bia nedep\u0103\u0219irii unei medii de 48 de ore pe s\u0103pt\u0103m\u00e2n\u0103 calculat\u0103 prin raportare la o perioad\u0103 de timp de maxim 12 luni.<\/p>\n<p>Aceast\u0103 limit\u0103 maxim\u0103 legal\u0103 este prev\u0103zut\u0103 pentru un singur contract individual de munc\u0103, \u00eens\u0103 legisla\u021bia nu prevede nimic \u00een cazul unei pluralit\u0103\u021bi de contracte de munc\u0103 \u00een persoana aceluia\u0219i salariat.<\/p>\n<p>Potrivit <strong>art. 35 din Codul Muncii<\/strong> o persoan\u0103 fizic\u0103 are dreptul de a \u00eencheia multiple contracte individuale de munc\u0103 la angajatori diferi\u021bi sau acela\u0219i angajator, cu singura condi\u021bie ca programul de munc\u0103 prev\u0103zut \u00een contractele \u00eencheiate s\u0103 nu se suprapun\u0103.<\/p>\n<p>Cu toate acestea, exist\u0103 \u0219i o interdic\u021bie implicit\u0103 care rezult\u0103 din textele legale \u0219i anume posibilitatea \u00eencheierii a dou\u0103 contracte de munc\u0103 pentru aceea\u0219i func\u021bie la acela\u0219i angajator. Se consider\u0103 c\u0103 o astfel de practic\u0103 ar eluda \u00een mod voit dispozi\u021biile referitoare la plata orelor suplimentare.<\/p>\n<p>Pentru ra\u021bionamente similare, \u0219i anume protejarea salariatului \u00eempotriva unui abuz din partea angajatorului, consider\u0103m c\u0103 \u00eencheierea a dou\u0103 sau mai multe contracte individuale de munc\u0103 la acela\u0219i angajator (pentru func\u021bii diferite \u00een mod obligatoriu cum am ar\u0103tat mai sus) ar putea fi f\u0103cut\u0103 doar cu respectarea duratei maxime a timpului de lucru \u0219i a repausului obligatoriu de 24 de ore dup\u0103 un program de munc\u0103 de 12 ore \u00eentr-o zi.<\/p><p><span style=\"font-style: inherit; font-weight: inherit; font-family: var( --e-global-typography-text-font-family ), Sans-serif; background-color: var(--ast-global-color-6);\">Nu la fel putem interpreta situa\u021bia unui cumul de contracte de munc\u0103 la diferi\u021bi angajatori. \u00centr-o atare situa\u021bie, se consider\u0103 c\u0103 salariatul a ac\u021bionat \u00een mod con\u0219tient \u0219i voluntar, iar o limitare privind num\u0103rul maxim de ore de munc\u0103 adunate din cele dou\u0103 contracte, de\u0219i la o prim\u0103 vedere ar fi \u00een considerat\u0103 o reglementare ce-l poate proteja \u00eempotriva unei suprasolicit\u0103ri, \u00een realitate trebuie interpretat\u0103 c\u0103 o restr\u00e2ngere a dreptului la
