Reprezentan\u021bii sunt ale\u0219i cu majoritatea voturilor angaja\u021bilor \u0219i sunt proteja\u021bi \u00eempotriva oric\u0103ror interven\u021bii din partea angajatorului sau a autorit\u0103\u021bilor \u00een acest proces. Totodat\u0103, pentru desf\u0103\u0219urarea alegerilor, un grup de ini\u021biativ\u0103 poate elabora \u0219i comunica procedurile de vot, iar angajatorul trebuie s\u0103 sprijine aceste proceduri \u0219i s\u0103 informeze to\u021bi angaja\u021bii despre ele.<\/p><p><strong>Num\u0103rul Reprezentan\u021bilor<\/strong><\/p><p>Reprezentan\u021bii trebuie s\u0103 fie angaja\u021bi cu contract de munc\u0103 \u0219i s\u0103 aib\u0103 cel pu\u021bin 18 ani. Num\u0103rul de reprezentan\u021bi variaz\u0103 \u00een func\u021bie de dimensiunea companiei:<\/p><ul><li>P\u00e2n\u0103 la 100 de angaja\u021bi: maximum 2 reprezentan\u021bi;<\/li><li>101 &#8211; 500 angaja\u021bi: maximum 3 reprezentan\u021bi;<\/li><li>501 &#8211; 1.000 angaja\u021bi: maximum 4 reprezentan\u021bi;<\/li><li>1.001 &#8211; 2.000 angaja\u021bi: maximum 5 reprezentan\u021bi;<\/li><li>Peste 2.000 de angaja\u021bi: maximum 6 reprezentan\u021bi.<\/li><\/ul><p>Mandatul lor este limitat la doi ani \u0219i nu poate include persoane din pozi\u021biile de conducere ale companiei.<\/p><p><strong>Atribu\u021biile Reprezentan\u021bilor Angaja\u021bilor<\/strong><\/p><p>Rolurile principale ale reprezentan\u021bilor sunt legate de:<\/p><ul><li>Contribuirea la elaborarea regulamentului intern;<\/li><li>Semnalarea problemelor legale la inspectoratul teritorial de munc\u0103;<\/li><li>Participarea la negocierile pentru contractul colectiv de munc\u0103.<\/li><\/ul><p>Durata \u0219i detaliile activit\u0103\u021bilor lor se stabilesc prin acordul colectiv sau prin negociere direct\u0103 cu angajatorul.<\/p><p><strong>Protec\u021bia Reprezentan\u021bilor \u00een Exercitarea Mandatului<\/strong><\/p><p>Reprezentan\u021bii angaja\u021bilor beneficiaz\u0103 de protec\u021bie juridic\u0103, ceea ce \u00eenseamn\u0103 c\u0103 angajatorul nu le poate modifica sau desface contractele de munc\u0103 din motive legate de activitatea lor ca reprezentan\u021bi. De asemenea, sunt proteja\u021bi \u00eempotriva oric\u0103ror interferen\u021be din partea angajatorului sau a autorit\u0103\u021bilor \u00een timpul exercit\u0103rii atribu\u021biilor.<\/p><p><strong>Concluzie<\/strong><\/p><p><strong>Reprezentan\u021bii angaja\u021bilor reprezint\u0103 o alternativ\u0103 viabil\u0103 pentru angaja\u021bi \u00een cazul \u00een care nu exist\u0103 un sindicat, asigur\u00e2ndu-le acestora un mediu de lucru mai sigur \u0219i echitabil.
