Aceste m\u0103suri sunt destinate s\u0103 protejeze asigura\u021bii pe perioada \u00een care nu pot desf\u0103\u0219ura activitatea profesional\u0103 din cauza unei boli sau accident.<\/p><p><strong>Cum se acord\u0103 indemniza\u021biile pentru incapacitate temporar\u0103 de munc\u0103?<\/strong><\/p><p>Indemniza\u021biile pentru incapacitatea temporar\u0103 de munc\u0103 sunt suportate \u00een dou\u0103 etape:<\/p><ul><li>De c\u0103tre angajator: \u00cen primele 5 zile de incapacitate temporar\u0103 de munc\u0103, indemniza\u021bia este pl\u0103tit\u0103 de angajator, cu excep\u021bia cazurilor \u00een care sunt aplicabile m\u0103surile de izolare, conform Legii nr. 136\/2020.<\/li><li>Din Fondul Na\u021bional Unic de Asigur\u0103ri Sociale de S\u0103n\u0103tate: Dup\u0103 perioada men\u021bionat\u0103, indemniza\u021bia este suportat\u0103 de c\u0103tre stat, din bugetul Fondului Na\u021bional Unic de Asigur\u0103ri Sociale de S\u0103n\u0103tate. De asemenea, \u00een anumite cazuri, plata indemniza\u021biei \u00eencepe din prima zi a incapacit\u0103\u021bii (pentru anumite categorii de asigura\u021bi, inclusiv persoanele izolate).<\/li><\/ul><p><strong>Durata concediului \u0219i a indemniza\u021biei<\/strong><\/p><p>Concediul medical pentru incapacitate temporar\u0103 de munc\u0103 nu poate dep\u0103\u0219i 90 de zile\u00a0<span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight ); background-color: var(--ast-global-color-6); font-size: 1rem;\">\u00eentr-un interval de un an,\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight ); background-color: var(--ast-global-color-6); font-size: 1rem;\">\u00eencep\u00e2nd cu a 91-a zi,\u00a0<\/span><span style=\"font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight ); background-color: var(--ast-global-color-6); font-size: 1rem;\">\u00een anumite condi\u021bii,<\/span><span style=\"font-size: 1rem; font-style: inherit; font-weight: var( --e-global-typography-text-font-weight ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; background-color: var(--ast-global-color-6);\">\u00a0poate fi prelungit p\u00e2n\u0103 la<\/span><span style=\"font-style: inherit; font-weight: inherit; font-family: var( --e-global-typography-text-font-family ), Sans-serif; background-color: var(--ast-global-color-6);\">\u00a0183 de zile, cu aprobarea medicului expert al asigur\u0103rilor sociale.<\/span><\/p><p>Pentru anumite boli speciale sau afec\u021biuni grave, precum boli cardiovasculare, tuberculoza, neoplazii \u0219i SIDA, durata concediului \u0219i indemniza\u021biei poate fi extins\u0103 semnificativ. De exemplu, pentru SIDA sau neoplazii, durata poate ajunge p\u00e2n\u0103 la un an \u0219i jum\u0103tate, iar pentru tuberculoz\u0103 sau arsuri grave, concediul \u0219i indemniza\u021bia se acord\u0103 pe \u00eentreaga perioad\u0103 de tratament.<\/p><p><strong>Pensionarea de invaliditate<\/strong><\/p><p>\u00cen cazul \u00een care o persoan\u0103 nu este recuperat\u0103 la finalul perioadei maxime de acordare a indemniza\u021biei, medicul specialist poate propune pensionarea de invaliditate. Totu\u0219i, dac\u0103 exist\u0103 \u0219anse de recuperare, medicul poate propune prelungirea concediului medical pentru a evita pensionarea prematur\u0103.<\/p><p>Pensionarii care se afl\u0103 \u00eentr-o situa\u021bie de incapacitate temporar\u0103 de munc\u0103 beneficiaz\u0103 de acelea\u0219i drepturi ca \u0219i ceilal\u021bi asigura\u021bi, cu anumite excep\u021bii. Ace\u0219tia pot beneficia de indemniza\u021bie, chiar \u0219i \u00een timpul concediului de odihn\u0103 sau al concediului f\u0103r\u0103 plat\u0103, conform prevederilor legale.<\/p><p><strong>Calculul indemniza\u021biei<\/strong><\/p><p>Indemniza\u021bia pentru incapacitate temporar\u0103 de munc\u0103 este calculat\u0103 \u00een func\u021bie de baza de calcul stabilit\u0103 \u00een legisla\u021bia specific\u0103. \u00cen general, cuantumul brut lunar al indemniza\u021biei este de 75% din baza de calcul, iar \u00een cazurile de tuberculoz\u0103, SIDA, neoplazii, boli infectocontagioase din grupa A sau urgen\u021be medico-chirurgicale, cuantumul indemniza\u021biei poate ajunge la 100% din baza de calcul.<\/p><p><strong>Planul de urm\u0103rire a evolu\u021biei bolii<\/strong><\/p><p>Medicii care elibereaz\u0103 certificate de concediu medical pentru incapacitate temporar\u0103 de munc\u0103 sunt obliga\u021bi s\u0103 \u00eentocmeasc\u0103 un plan de urm\u0103rire a evolu\u021biei bolii. Acesta va include indica\u021biile terapeutice \u0219i igieno-dietetice ce trebuie respectate de persoana asigurat\u0103.<\/p><p><strong>Concluzie<\/strong><\/p><p><strong>Dreptul la concediu medical \u0219i indemniza\u021bie pentru incapacitate temporar\u0103 de munc\u0103 reprezint\u0103 o m\u0103sur\u0103 important\u0103 de protec\u021bie social\u0103 pentru angaja\u021bi \u0219i pensionari. Este esen\u021bial ca at\u00e2t angajatorii, c\u00e2t \u0219i asigura\u021bii s\u0103 fie informa\u021bi corect despre reglement\u0103rile \u00een vigoare \u0219i s\u0103 beneficieze de toate drepturile prev\u0103zute de lege \u00een caz de boal\u0103 sau accident. Dac\u0103 ave\u021bi nevoie de asisten\u021b\u0103 juridic\u0103 sau consulta\u021bii legale privind aceste drepturi, nu ezita\u021bi s\u0103 contacta\u021bi un avocat
