Aceasta are rolul de a administra, \u00eentre\u021bine, reabilita \u0219i moderniza proprietatea comun\u0103, asigur\u00e2nd respectarea drepturilor \u0219i obliga\u021biilor fiec\u0103rui proprietar.<\/p><ol><li><strong>Condi\u021biile pentru \u00eenfiin\u021barea unei asocia\u021bii de proprietari<\/strong><\/li><\/ol><p>Pentru a \u00eenfiin\u021ba o asocia\u021bie de proprietari este necesar acordul scris a cel pu\u021bin jum\u0103tate plus unu din num\u0103rul total al proprietarilor dintr-un condominiu. \u00cen cazul imobilelor cu mai multe tronsoane sau sc\u0103ri, se pot constitui asocia\u021bii separate, cu condi\u021bia ca proprietatea comun\u0103 s\u0103 fie clar delimitat\u0103 \u0219i s\u0103 existe bran\u0219amente separate.<\/p><ol start=\"2\"><li><strong>Pa\u0219ii pentru constituirea asocia\u021biei de proprietari<\/strong><\/li><\/ol><p style=\"padding-left: 40px;\">A. Organizarea adun\u0103rii ini\u021biale<\/p><ul><li>\u00cenainte de constituirea efectiv\u0103, proprietarii se reunesc pentru a decide asupra \u00eenfiin\u021b\u0103rii asocia\u021biei.<\/li><li>Se desemneaz\u0103 o persoan\u0103 fizic\u0103 sau juridic\u0103 responsabil\u0103 cu redactarea acordului de asociere \u0219i a statutului.<\/li><li>Se stabile\u0219te termenul de finalizare a documentelor \u0219i data adun\u0103rii de constituire.<\/li><li>Hot\u0103r\u00e2rile luate se consemneaz\u0103 \u00eentr-un proces-verbal semnat de cei prezen\u021bi.<\/li><\/ul><p style=\"padding-left: 40px;\">B. Convocarea adun\u0103rii de constituire<\/p><ul><li>Cu cel pu\u021bin 10 zile \u00eenainte de \u0219edin\u021b\u0103, proprietarii sunt convoca\u021bi prin afi\u0219are la avizier \u0219i tabel convocator, care trebuie semnat de cel pu\u021bin 50% plus unu din num\u0103rul total al proprietarilor.<\/li><\/ul><p style=\"padding-left: 40px;\">C. Adoptarea statutului<\/p><ul><li>\u00cen cadrul adun\u0103rii, se aprob\u0103 statutul asocia\u021biei, care trebuie s\u0103 con\u021bin\u0103 informa\u021bii privind denumirea, sediul, scopul, structura veniturilor \u0219i cheltuielilor, drepturile \u0219i obliga\u021biile membrilor, modul de organizare \u0219i func\u021bionare, repartizarea cheltuielilor \u0219i condi\u021biile de dizolvare.<\/li><li>Se stabile\u0219te \u0219i posibilitatea asigur\u0103rii unui spa\u021biu de administrare adecvat pentru p\u0103strarea documentelor asocia\u021biei.<\/li><\/ul><p style=\"padding-left: 40px;\">D. \u00cenregistrarea asocia\u021biei la judec\u0103torie<\/p><ul><li>Pentru dob\u00e2ndirea personalit\u0103\u021bii juridice, se depune la judec\u0103toria competent\u0103 o cerere \u00eenso\u021bit\u0103 de:<\/li><\/ul><ol><li>Statutul asocia\u021biei;<\/li><li>Acordul de asociere, care include date despre propriet\u0103\u021bi, proprietari \u0219i cota-parte indiviz\u0103;<\/li><li>Procesul-verbal al adun\u0103rii de constituire.<\/li><\/ol><p>Odat\u0103 \u00eenregistrat\u0103, asocia\u021bia de proprietari devine o entitate juridic\u0103 cu drepturi \u0219i obliga\u021bii fa\u021b\u0103 de ter\u021bi \u00een ceea ce prive\u0219te administrarea condominiului.<\/p><p><strong>Concluzie<\/strong><\/p><p><strong>\u00cenfiin\u021barea unei asocia\u021bii de proprietari este un proces esen\u021bial pentru gestionarea eficient\u0103 a unui condominiu.
