Aceste reglement\u0103ri au rolul de a asigura transparen\u021ba \u00een gestionarea imobilelor \u0219i de a proteja drepturile \u0219i obliga\u021biile fiec\u0103rei p\u0103r\u021bi implicate. \u00cen acest articol, vom explora principalele prevederi legale aplicabile la \u00eenstr\u0103inarea locuin\u021belor \u0219i altor spa\u021bii din condominii, conform Articolului 33 din legisla\u021bia actual\u0103.<\/p><ol><li><strong>Dovada Pl\u0103\u021bii Cotelor de Contribu\u021bie<\/strong><\/li><\/ol><p>Unul dintre pa\u0219ii esen\u021biali la \u00eenstr\u0103inarea unei unit\u0103\u021bi de proprietate dintr-un condominiu este ca proprietarul s\u0103 fac\u0103 dovada pl\u0103\u021bii la zi a cotelor de contribu\u021bie c\u0103tre asocia\u021bia de proprietari \u0219i a utilit\u0103\u021bilor publice. Aceste cotiza\u021bii sunt esen\u021biale pentru men\u021binerea bun\u0103st\u0103rii \u0219i \u00eentre\u021binerii spa\u021biilor comune ale imobilului. Astfel, la \u00eentocmirea actului de \u00eenstr\u0103inare, proprietarul trebuie s\u0103 prezinte un certificat din partea asocia\u021biei de proprietari care s\u0103 ateste plata cotelor de contribu\u021bie.<\/p><ol start=\"2\"><li><strong>Documentele Necesare pentru Autentificarea Actului Notarial<\/strong><\/li><\/ol><p>Notarii publici pot autentifica actele de \u00eenstr\u0103inare numai dac\u0103 sunt \u00eendeplinite anumite condi\u021bii. \u00cen primul r\u00e2nd, proprietarul trebuie s\u0103 prezinte adeverin\u021ba emis\u0103 de asocia\u021bia de proprietari, care confirm\u0103 plata cotelor sau, \u00een cazul \u00een care exist\u0103 datorii, cuantumul acestora. Aceast\u0103 adeverin\u021b\u0103 va include informa\u021bii esen\u021biale, precum numele administratorului \u0219i pre\u0219edintelui asocia\u021biei \u0219i va fi valabil\u0103 timp de 30 de zile calendaristice.<\/p><p>\u00cen situa\u021biile \u00een care asocia\u021bia de proprietari nu exist\u0103 sau nu este func\u021bional\u0103, proprietarul va trebui s\u0103 prezinte o declara\u021bie pe proprie r\u0103spundere cu privire la plata cotelor \u0219i utilit\u0103\u021bilor.<\/p><ol start=\"3\"><li><strong>Preluarea Datoriilor de C\u0103tre Dob\u00e2nditor<\/strong><\/li><\/ol><p>\u00cen cazul \u00een care exist\u0103 datorii c\u0103tre asocia\u021bia de proprietari sau c\u0103tre furnizorii de utilit\u0103\u021bi publice, notarul poate autentifica actul de \u00eenstr\u0103inare doar dac\u0103 dob\u00e2nditorul accept\u0103 s\u0103 preia aceste datorii. Acesta va trebui s\u0103 semneze o declara\u021bie prin care \u00ee\u0219i asum\u0103 \u00eentreaga responsabilitate pentru plata debitelor.<\/p><ol start=\"4\"><li><strong>Obligativitatea Transmiterii Documentelor Relevante<\/strong><\/li><\/ol><p>La \u00eenstr\u0103inarea unui imobil, proprietarul are obliga\u021bia de a transmite c\u0103tre noul proprietar toate documentele relevante care pot afecta drepturile \u0219i obliga\u021biile legate de proprietate. Acestea includ, printre altele, certificatul de performan\u021b\u0103 energetic\u0103 al imobilului. \u00cen actul de \u00eenstr\u0103inare, p\u0103r\u021bile vor declara c\u0103 aceste obliga\u021bii au fost \u00eendeplinite.<\/p><ol start=\"5\"><li><strong>Informa\u021biile Necesare pentru Calculul Cotelor de Contribu\u021bie<\/strong><\/li><\/ol><p>Dup\u0103 finalizarea actului de \u00eenstr\u0103inare, noul proprietar are obliga\u021bia de a prezenta asocia\u021biei de proprietari informa\u021biile necesare pentru calculul cotelor de contribu\u021bie la cheltuielile comune ale condominiului. Aceste informa\u021bii trebuie transmise \u00een termen de 10 zile lucr\u0103toare de la transferul dreptului de proprietate.<\/p><ol start=\"6\"><li><strong>\u00cenchirierea \u0219i Alte Drepturi Reale<\/strong><\/li><\/ol><p>\u00cen cazul \u00eenchirierii, constituirii unor drepturi reale de uz, uzufruct sau abita\u021bie, obliga\u021bia de plat\u0103 a cotelor de \u00eentre\u021binere revine \u00een continuare proprietarului, care poate recupera aceste sume de la beneficiarii dreptului de folosin\u021b\u0103.<\/p><ol start=\"7\"><li><strong>Datoria Asocia\u021biei de Proprietari de a Elibera Adeverin\u021be<\/strong><\/li><\/ol><p>La solicitarea oric\u0103rui proprietar, pre\u0219edintele \u0219i administratorul asocia\u021biei sunt obliga\u021bi s\u0103 elibereze adeverin\u021bele care dovedesc plata cotelor de contribu\u021bie sau existen\u021ba unor datorii. Aceste adeverin\u021be trebuie eliberate \u00een termen de 3 zile lucr\u0103toare de la primirea solicit\u0103rii.<\/p><ol start=\"8\"><li><strong>Notarea Datoriilor \u00een Cartea Funciar\u0103<\/strong><\/li><\/ol><p>Dac\u0103 exist\u0103 datorii mai vechi de 3 luni \u0219i care dep\u0103\u0219esc valoarea salariului minim pe economie, pre\u0219edintele sau administratorul asocia\u021biei de proprietari are obliga\u021bia de a solicita notarea acestor debite \u00een cartea funciar\u0103. Este important de men\u021bionat c\u0103 aceast\u0103 notare se face f\u0103r\u0103 plata taxei de timbru.<\/p><p><strong>Concluzie<\/strong><\/p><p><strong>\u00censtr\u0103inarea unei unit\u0103\u021bi de proprietate \u00eentr-un condominiu implic\u0103 o serie de obliga\u021bii legale at\u00e2t pentru v\u00e2nz\u0103tori, c\u00e2t \u0219i pentru cump\u0103r\u0103tori. De la datoria de a pl\u0103ti cotele de \u00eentre\u021binere \u0219i utilit\u0103\u021bile publice, p\u00e2n\u0103 la transmiterea documentelor relevante \u0219i asigurarea prelu\u0103rii debitelor existente, fiecare parte trebuie s\u0103 respecte procedurile stabilite de lege.
