Codul civil reglementeaz\u0103 garan\u021bia contra viciilor bunului v\u00e2ndut, stabilind drepturile cump\u0103r\u0103torului \u0219i obliga\u021biile v\u00e2nz\u0103torului.<\/p><p><strong>Ce este un viciu ascuns?<\/strong><\/p><p>Un viciu ascuns este un defect care exist\u0103 la data pred\u0103rii bunului, dar care nu putea fi descoperit de un cump\u0103r\u0103tor prudent f\u0103r\u0103 asisten\u021b\u0103 de specialitate. Acest defect poate face bunul impropriu utiliz\u0103rii sale sau poate diminua valoarea sa astfel \u00eenc\u00e2t, dac\u0103 ar fi fost cunoscut, cump\u0103r\u0103torul nu ar fi cump\u0103rat bunul sau ar fi pl\u0103tit un pre\u021b mai mic.<\/p><p><strong>Drepturile cump\u0103r\u0103torului<\/strong><\/p><p>Dac\u0103 un bun prezint\u0103 vicii ascunse, cump\u0103r\u0103torul are urm\u0103toarele op\u021biuni:<\/p><ul><li>Remedierea viciilor de c\u0103tre v\u00e2nz\u0103tor sau pe cheltuiala acestuia;<\/li><li>\u00cenlocuirea bunului cu un altul de acela\u0219i fel, dar f\u0103r\u0103 vicii;<\/li><li>Reducerea pre\u021bului propor\u021bional cu defectele constatate;<\/li><li>Rezolu\u021biunea contractului, dac\u0103 defectele sunt grave.<\/li><\/ul><p>Dac\u0103 v\u00e2nz\u0103torul cuno\u0219tea viciile bunului la momentul v\u00e2nz\u0103rii, el poate fi obligat \u0219i la plata de daune-interese pentru prejudiciul cauzat.<\/p><p><strong>Condi\u021biile garan\u021biei<\/strong><\/p><p>Pentru ca un cump\u0103r\u0103tor s\u0103 poat\u0103 invoca garan\u021bia pentru vicii ascunse, trebuie s\u0103 respecte anumite condi\u021bii:<\/p><ul><li>Viciul s\u0103 existe la momentul pred\u0103rii bunului.<\/li><li>Cump\u0103r\u0103torul s\u0103 nu fi avut cuno\u0219tin\u021b\u0103 despre viciu la \u00eencheierea contractului.<\/li><li>Viciul s\u0103 fie notificat v\u00e2nz\u0103torului \u00eentr-un termen rezonabil dup\u0103 descoperirea sa.<\/li><\/ul><p>Dac\u0103 v\u00e2nz\u0103torul a ascuns inten\u021bionat viciul, acesta nu poate invoca exonerarea de r\u0103spundere.<\/p><p><strong>Limit\u0103ri ale garan\u021biei<\/strong><\/p><p>Garan\u021bia contra viciilor ascunse nu se aplic\u0103:<\/p><ul><li>Dac\u0103 viciile erau cunoscute de cump\u0103r\u0103tor la momentul v\u00e2nz\u0103rii;<\/li><li>\u00cen cazul v\u00e2nz\u0103rilor silite realizate prin licita\u021bie public\u0103;<\/li><li>Dac\u0103 p\u0103r\u021bile au convenit limitarea sau excluderea garan\u021biei, cu excep\u021bia situa\u021biilor \u00een care v\u00e2nz\u0103torul a cunoscut viciile \u0219i nu le-a divulgat.<\/li><\/ul><p><strong>Concluzie<\/strong><\/p><p>Garan\u021bia contra viciilor ascunse este o protec\u021bie esen\u021bial\u0103 pentru cump\u0103r\u0103tor, iar cunoa\u0219terea drepturilor \u0219i obliga\u021biilor ce decurg din lege poate preveni litigii costisitoare. Dac\u0103 ai achizi\u021bionat un bun \u0219i suspectezi c\u0103 are vicii ascunse, consult\u0103 un avocat specializat pentru a identifica cea mai bun\u0103 solu\u021bie
