Potrivit articolului 6 din GDPR, prelucrarea datelor este legal\u0103 doar dac\u0103 se aplic\u0103 cel pu\u021bin una dintre urm\u0103toarele condi\u021bii:<\/p><ul><li>Consim\u021b\u0103m\u00e2ntul persoanei vizate &#8211; Persoana vizat\u0103 trebuie s\u0103 \u00ee\u0219i dea acordul explicit pentru prelucrarea datelor sale \u00eentr-un scop bine definit.<\/li><li>Executarea unui contract &#8211; Prelucrarea este necesar\u0103 pentru derularea unui contract \u00een care persoana vizat\u0103 este parte sau pentru a face demersuri la cererea acesteia.<\/li><li>Obliga\u021bie legal\u0103 &#8211; Operatorul de date trebuie s\u0103 prelucreze datele pentru a respecta o obliga\u021bie impus\u0103 de lege.<\/li><li>Protejarea intereselor vitale &#8211; Datele pot fi prelucrate pentru protejarea vie\u021bii sau integrit\u0103\u021bii persoanei vizate sau a altei persoane.<\/li><li>Interes public sau autoritate public\u0103 &#8211; Prelucrarea este necesar\u0103 pentru exercitarea unei atribu\u021bii oficiale sau a unui interes public.<\/li><li>Interesul legitim &#8211; Operatorul sau o parte ter\u021b\u0103 poate prelucra date dac\u0103 are un interes legitim care nu prejudiciaz\u0103 drepturile fundamentale ale persoanei vizate.<\/li><\/ul><p><strong>Consim\u021b\u0103m\u00e2ntul \u0219i retragerea acestuia<\/strong><\/p><p>Atunci c\u00e2nd prelucrarea datelor se bazeaz\u0103 pe consim\u021b\u0103m\u00e2nt, operatorul trebuie s\u0103 poat\u0103 demonstra c\u0103 acesta a fost acordat \u00een mod liber \u0219i informat. Cererea de consim\u021b\u0103m\u00e2nt trebuie s\u0103 fie clar\u0103, separat\u0103 de alte clauze \u0219i exprimat\u0103 \u00eentr-un limbaj accesibil.<\/p><p>Persoana vizat\u0103 are dreptul s\u0103-\u0219i retrag\u0103 consim\u021b\u0103m\u00e2ntul \u00een orice moment, iar procesul de retragere trebuie s\u0103 fie la fel de simplu ca acordarea acestuia. Retragerea consim\u021b\u0103m\u00e2ntului nu afecteaz\u0103 legalitatea prelucr\u0103rii anterioare retragerii.<\/p><p><strong>Concluzie<\/strong><\/p><p>Legalitatea prelucr\u0103rii datelor cu caracter personal este esen\u021bial\u0103 pentru protec\u021bia drepturilor individuale. Fie c\u0103 e vorba de consim\u021b\u0103m\u00e2nt, obliga\u021bii contractuale sau interese publice, orice prelucrare trebuie s\u0103 respecte principiile GDPR.
