Iat\u0103 ce trebuie s\u0103 \u0219tii.<\/p><ol><li><strong>Munca suplimentar\u0103<\/strong><\/li><\/ol><p>Defini\u021bie: Orice munc\u0103 prestat\u0103 peste durata normal\u0103 a timpului de lucru s\u0103pt\u0103m\u00e2nal (de regul\u0103 40 de ore pe s\u0103pt\u0103m\u00e2n\u0103) este considerat\u0103 munc\u0103 suplimentar\u0103.<\/p><p>Reguli principale:<\/p><ul><li>Se poate efectua doar cu acordul salariatului, cu excep\u021bia cazurilor de for\u021b\u0103 major\u0103 sau a lucr\u0103rilor urgente pentru prevenirea ori \u00eenl\u0103turarea unor accidente.<\/li><li>Este interzis\u0103 dep\u0103\u0219irea limitelor legale de munc\u0103 suplimentar\u0103, \u00een afara situa\u021biilor de urgen\u021b\u0103.<\/li><\/ul><p>Compensarea muncii suplimentare:<\/p><p>Ore libere pl\u0103tite \u2013 trebuie acordate \u00een termen de 90 de zile de la efectuarea muncii suplimentare.<\/p><p>Plat\u0103 cu spor \u2013 dac\u0103 nu se pot acorda ore libere \u00een termen, salariatul prime\u0219te un spor de cel pu\u021bin 75% din salariul de baz\u0103.<\/p><p>\u00cen perioadele de reducere a activit\u0103\u021bii, angajatorul poate acorda zile libere pl\u0103tite \u00een avans, urm\u00e2nd ca acestea s\u0103 fie compensate ulterior prin munc\u0103 suplimentar\u0103.<\/p><p>Restric\u021bii: Tinerii sub 18 ani nu pot presta munc\u0103 suplimentar\u0103.<\/p><ol start=\"2\"><li><strong>Munca de noapte<\/strong><\/li><\/ol><p>Defini\u021bie: Orice munc\u0103 prestat\u0103 \u00eentre orele 22:00 \u0219i 06:00.<\/p><p>Cine este considerat salariat de noapte:<\/p><ul><li>Cel care lucreaz\u0103 cel pu\u021bin 3 ore de noapte pe zi;<\/li><li>Sau cel care efectueaz\u0103 munc\u0103 de noapte \u00een propor\u021bie de cel pu\u021bin 30% din timpul lunar de lucru.<\/li><\/ul><p>Reguli \u0219i limit\u0103ri:<\/p><p>Durata normal\u0103 nu poate dep\u0103\u0219i, \u00een medie, 8 ore pe zi pe o perioad\u0103 de referin\u021b\u0103 de maximum 3 luni.<\/p><p>Pentru condi\u021bii speciale\/deosebite, durata de 8 ore poate fi dep\u0103\u0219it\u0103 doar prin contract colectiv \u0219i cu respectarea prevederilor legale.<\/p><p>Angajatorii care folosesc frecvent munca de noapte trebuie s\u0103 anun\u021be Inspectoratul Teritorial de Munc\u0103.<\/p><p>Drepturi pentru munca de noapte:<\/p><ul><li>Program redus cu o or\u0103 pentru zilele \u00een care se lucreaz\u0103 cel pu\u021bin 3 ore de noapte, f\u0103r\u0103 reducerea salariului,<\/li><\/ul><p>sau<\/p><ul><li>Spor de 25% din salariul de baz\u0103 pentru timpul lucrat noaptea.<\/li><\/ul><p>Examen medical: Obligatoriu \u00eenainte de \u00eenceperea muncii de noapte \u0219i periodic, gratuit.<\/p><p>Salaria\u021bii cu probleme de s\u0103n\u0103tate cauzate de munca de noapte vor fi trecu\u021bi la un program de zi.<\/p><p>Restric\u021bii: Tinerii sub 18 ani, femeile gravide, l\u0103uzele, cele care al\u0103pteaz\u0103 \u0219i p\u0103rin\u021bii singuri din familii monoparentale nu pot fi obliga\u021bi s\u0103 lucreze noaptea.<\/p><p><strong>Concluzie<\/strong><\/p><p><strong>Munca suplimentar\u0103 \u0219i munca de noapte sunt reglementate strict pentru a proteja s\u0103n\u0103tatea \u0219i drepturile salaria\u021bilor. Este important s\u0103 cunoa\u0219te\u021bi aceste reguli pentru a v\u0103 asigura c\u0103 primi\u021bi compensa\u021biile legale \u0219i c\u0103 nu dep\u0103\u0219i\u021bi limitele prev\u0103zute de lege. \u00cen caz de neclarit\u0103\u021bi, consultarea unui avocat specializat \u00een dreptul muncii v\u0103 poate ajuta s\u0103 v\u0103 proteja\u021bi
