Fie c\u0103 vorbim despre v\u00e2nzarea unei companii, preluarea unei unit\u0103\u021bi sau transferul unei p\u0103r\u021bi din activitate c\u0103tre un alt angajator, salaria\u021bii trebuie s\u0103 \u0219tie c\u0103 legea le ofer\u0103 protec\u021bie special\u0103.<\/p><ol><li><strong>Ce \u00eenseamn\u0103 transferul \u00eentreprinderii<\/strong><\/li><\/ol><p>Transferul poate fi:<\/p><ul><li>al \u00eentregii \u00eentreprinderi (compania \u00een ansamblu),<\/li><li>al unei unit\u0103\u021bi (sediu, filial\u0103, punct de lucru),<\/li><li>sau al unei p\u0103r\u021bi din activitate (de exemplu, un departament).<\/li><\/ul><p>\u00cen toate aceste situa\u021bii, angaja\u021bii sunt proteja\u021bi de prevederile Codului muncii.<\/p><ol start=\"2\"><li><strong>Drepturile salaria\u021bilor la transfer<\/strong><\/li><\/ol><p>P\u0103strarea contractului de munc\u0103 \u2013 drepturile \u0219i obliga\u021biile pe care le aveau \u00een raport cu fostul angajator (cedentul) sunt preluate integral de noul angajator (cesionarul).<\/p><p>Interdic\u021bia concedierii \u2013 transferul nu poate fi folosit ca pretext pentru concedieri, fie ele individuale sau colective.<\/p><p>Continuitatea rela\u021biei de munc\u0103 \u2013 angajatul \u00ee\u0219i p\u0103streaz\u0103 func\u021bia, vechimea \u0219i toate drepturile salariale \u0219i extra-salariale existente la momentul transferului.<\/p><ol start=\"3\"><li><strong>Obliga\u021bia de informare \u0219i consultare<\/strong><\/li><\/ol><p>At\u00e2t cedentul, c\u00e2t \u0219i cesionarul trebuie s\u0103 informeze \u0219i s\u0103 consulte sindicatul sau reprezentan\u021bii salaria\u021bilor \u00eenainte de transfer.<\/p><p>Informa\u021biile trebuie s\u0103 acopere:<\/p><ul><li>implica\u021biile juridice (ce se schimb\u0103 din punct de vedere legal),<\/li><li>implica\u021biile economice (condi\u021biile financiare),<\/li><li>implica\u021biile sociale (impactul asupra salaria\u021bilor).<\/li><\/ul><p><strong>Concluzie<\/strong><\/p><p><strong>Transferul unei \u00eentreprinderi nu \u00eenseamn\u0103 pierderea locului de munc\u0103 sau a drepturilor c\u00e2\u0219tigate. Legea asigur\u0103 continuitatea contractelor \u0219i protec\u021bia angaja\u021bilor, impun\u00e2nd angajatorilor transparen\u021b\u0103 \u0219i consultare prealabil\u0103.
