Procedura de evaluare este una reglementat\u0103 strict prin lege \u0219i implic\u0103 at\u00e2t examinarea clinic\u0103 a victimei, c\u00e2t \u0219i o analiz\u0103 detaliat\u0103 a documentelor medicale.<\/p><p><strong>Cine realizeaz\u0103 evaluarea?<\/strong><\/p><p>Calculul punctajului traumatologic \u2013 folosit pentru a stabili desp\u0103gubirea acordat\u0103 victimei \u2013 se face contra cost, la cerere. Solicitarea poate fi depus\u0103 de:<\/p><ul><li>persoana prejudiciat\u0103,<\/li><li>asigur\u0103torul RCA,<\/li><li>Biroul Asigur\u0103torilor de Autovehicule din Rom\u00e2nia (BAAR),<\/li><li>Fondul de Garantare a Asigura\u021bilor (FGA).<\/li><\/ul><p>Examinarea este efectuat\u0103 de medici exper\u021bi evaluatori \u2013 speciali\u0219ti \u00een medicin\u0103 legal\u0103, exper\u021bi \u00een evaluarea capacit\u0103\u021bii de munc\u0103 sau medici care au absolvit cursul postuniversitar dedicat evalu\u0103rii prejudiciului moral \u00een caz de traumatisme rutiere.<\/p><p><strong>Cum se desf\u0103\u0219oar\u0103 examinarea?<\/strong><\/p><p>Victima este supus\u0103 unei expertize de evaluare \u00een cadrul c\u0103reia medicul:<\/p><ul><li>identific\u0103 \u0219i descrie toate leziunile traumatice \u0219i consecin\u021bele acestora,<\/li><li>verific\u0103 documentele medicale \u0219i corela\u021bia dintre diagnostic \u0219i accident,<\/li><li>diferen\u021biaz\u0103 leziunile produse de accident de eventualele afec\u021biuni preexistente sau ulterioare f\u0103r\u0103 leg\u0103tur\u0103 cu evenimentul,<\/li><li>acord\u0103 un punctaj total pe baza baremului de evaluare.<\/li><\/ul><p>Dac\u0103 documentele medicale sunt incomplete, se pot solicita investiga\u021bii suplimentare, cu acordul victimei.<\/p><p>Rezultatul final este consemnat \u00eentr-un raport detaliat, care include datele de identificare ale victimei, examenul clinic, complica\u021biile identificate, diagnosticul \u0219i punctajul acordat pentru fiecare leziune. Raportul este arhivat de medicul expert evaluator pentru cel pu\u021bin 10 ani.<\/p><p><strong>Cum se stabile\u0219te punctajul?<\/strong><\/p><p>Punctajul traumatologic ia \u00een calcul trei elemente distincte:<\/p><ul><li>Leziunea traumatic\u0103 ini\u021bial\u0103 (LT) \u2013 evaluat\u0103 \u00een func\u021bie de consecin\u021bele morfologice \u0219i fiziologice.<\/li><li>Complica\u021biile posttraumatice (CP) \u2013 cele imediate, acute sau cronice, care pot fi recuperate prin tratament.<\/li><li>Consecin\u021bele posttraumatice permanente (CPP) \u2013 leziunile ireversibile, care pot duce la invaliditate.<\/li><\/ul><p>\u00cen caz de leziuni multiple, punctajele se adun\u0103, dar nu pot dep\u0103\u0219i valoarea maxim\u0103 stabilit\u0103 de lege (corespunz\u0103toare st\u0103rii vegetative persistente \u2013 200 puncte).<\/p><p><strong>Concluzie<\/strong><\/p><p>Stabilirea corect\u0103 a punctajului traumatologic este esen\u021bial\u0103 pentru a ob\u021bine desp\u0103gubiri juste \u00een urma unui accident rutier. \u00centruc\u00e2t procedura implic\u0103 termene, documente \u0219i uneori discu\u021bii cu asigur\u0103torii, este recomandat s\u0103 apelezi la un avocat specializat, care te poate ghida pas cu pas \u0219i se poate asigura c\u0103 drepturile tale sunt respectate \u0219i c\u0103
