situa\u021biile excep\u021bionale \u00een care unit\u0103\u021bile de \u00eenv\u0103\u021b\u0103m\u00e2nt se \u00eenchid temporar \u2014 fie din cauza condi\u021biilor meteorologice, fie din alte motive de for\u021b\u0103 major\u0103 \u2014 p\u0103rin\u021bii pot beneficia de zile libere pl\u0103tite pentru supravegherea copiilor, potrivit unei legi speciale adoptate \u00een acest sens.<\/p><p><strong>Cine poate beneficia de zilele libere<\/strong><\/p><p>Dreptul se acord\u0103 unuia dintre p\u0103rin\u021bi, dac\u0103 sunt \u00eendeplinite simultan urm\u0103toarele condi\u021bii:<\/p><ul><li>copilul are v\u00e2rsta de p\u00e2n\u0103 la 12 ani, sau p\u00e2n\u0103 la 18 ani dac\u0103 are dizabilit\u0103\u021bi, fiind \u00eenscris \u00eentr-o unitate de \u00eenv\u0103\u021b\u0103m\u00e2nt;<\/li><li>locul de munc\u0103 nu permite telemunca sau munca de acas\u0103.<\/li><\/ul><p>De acelea\u0219i drepturi beneficiaz\u0103 \u0219i p\u0103rintele singur dintr-o familie monoparental\u0103, reprezentantul legal al copilului sau persoana desemnat\u0103 prin lege s\u0103 exercite drepturile p\u0103rinte\u0219ti.<\/p><p>Zilele libere se acord\u0103 pe \u00eentreaga perioad\u0103 \u00een care autorit\u0103\u021bile decid suspendarea cursurilor, iar cererea se depune la angajator, \u00eenso\u021bit\u0103 de o declara\u021bie pe proprie r\u0103spundere din partea celuilalt p\u0103rinte c\u0103 nu beneficiaz\u0103, la r\u00e2ndul s\u0103u, de aceste zile libere.<\/p><p><strong>Indemniza\u021bia acordat\u0103 p\u0103rin\u021bilor<\/strong><\/p><p>Pentru fiecare zi liber\u0103, p\u0103rintele prime\u0219te o indemniza\u021bie de 75% din salariul corespunz\u0103tor unei zile lucr\u0103toare, f\u0103r\u0103 a dep\u0103\u0219i echivalentul zilnic al a 75% din c\u00e2\u0219tigul salarial mediu brut utilizat la fundamentarea bugetului asigur\u0103rilor sociale de stat.<\/p><p>Sumele necesare pentru plata acestor indemniza\u021bii se achit\u0103 ini\u021bial de angajator, dar pot fi decontate ulterior din Fondul de garantare pentru plata crean\u021belor salariale, urm\u00e2nd ca fondul s\u0103 fie compensat din bugetul de stat.<\/p><p><strong>Reguli speciale pentru anumite categorii de angaja\u021bi<\/strong><\/p><p>\u00cen cazul unor domenii esen\u021biale \u2014 precum s\u0103n\u0103tate, energie, transporturi, comunica\u021bii sau salubritate \u2014 zilele libere se pot acorda numai cu acordul angajatorului, pentru a nu afecta serviciile publice vitale.<\/p><p><strong>Concluzie<\/strong><\/p><p><strong>Legea ofer\u0103 o protec\u021bie important\u0103 p\u0103rin\u021bilor care trebuie s\u0103 \u00ee\u0219i supravegheze copiii \u00een situa\u021bii de urgen\u021b\u0103, f\u0103r\u0103 a fi penaliza\u021bi financiar. Totu\u0219i, aplicarea sa presupune respectarea unei proceduri clare \u0219i depunerea documentelor justificative la timp.<\/strong><\/p><p><strong>Pentru nel\u0103muriri legate de drepturile salariale sau de interpretarea corect\u0103 a prevederilor legii, este recomandat s\u0103 consulta\u021bi un avocat specializat \u00een dreptul
