Una dintre cele mai importante este \u00eentocmirea \u0219i p\u0103strarea dosarului personal al fiec\u0103rui salariat.<\/p><p>Potrivit legisla\u021biei \u00een vigoare, fiecare angajator trebuie s\u0103 \u00eentocmeasc\u0103 un dosar personal pentru fiecare persoan\u0103 \u00eencadrat\u0103 cu contract individual de munc\u0103. Acesta trebuie p\u0103strat \u00een bune condi\u021bii la sediul angajatorului sau la sediul secundar, dac\u0103 acolo se desf\u0103\u0219oar\u0103 activitatea de angajare, \u0219i prezentat inspectorilor de munc\u0103 la solicitarea acestora.<\/p><p><strong>Con\u021binutul dosarului personal<\/strong><\/p><p>Dosarul personal al salariatului trebuie s\u0103 cuprind\u0103 cel pu\u021bin urm\u0103toarele documente:<\/p><ul><li>actele necesare angaj\u0103rii;<\/li><li>contractul individual de munc\u0103 \u0219i actele adi\u021bionale;<\/li><li>documentele referitoare la modificarea, suspendarea \u0219i \u00eencetarea contractului de munc\u0103;<\/li><li>acte de studii \u0219i certificate de calificare profesional\u0103;<\/li><li>orice alte documente care atest\u0103 legalitatea \u0219i corectitudinea \u00eenscrierilor \u00een Registrul general de eviden\u021b\u0103 a salaria\u021bilor.<\/li><\/ul><p>\u00cen situa\u021bia \u00een care p\u0103r\u021bile utilizeaz\u0103 semn\u0103tura electronic\u0103 avansat\u0103 sau calificat\u0103 pentru semnarea contractelor \u0219i a actelor adi\u021bionale, dosarul personal poate fi \u00eentocmit \u0219i p\u0103strat \u00een format electronic, cu respectarea regulilor privind arhivarea digital\u0103 \u0219i protec\u021bia datelor cu caracter personal.<\/p><p><strong>Drepturile salariatului<\/strong><\/p><p>Salariatul are dreptul de a solicita, \u00een scris, copii ale documentelor existente \u00een dosarul personal, iar angajatorul este obligat s\u0103 le elibereze \u00een termen de 15 zile lucr\u0103toare de la data solicit\u0103rii. Documentele se elibereaz\u0103 \u00een copie certificat\u0103 pentru conformitate cu originalul.<\/p><p>La \u00eencetarea activit\u0103\u021bii, angajatorul este obligat s\u0103 elibereze salariatului o adeverin\u021b\u0103 care s\u0103 ateste activitatea desf\u0103\u0219urat\u0103, durata acesteia, salariul, vechimea \u00een munc\u0103 \u0219i \u00een specialitate, precum \u0219i un extras din Registrul general de eviden\u021b\u0103 a salaria\u021bilor.<\/p><p><strong>Concluzie<\/strong><\/p><p>Respectarea obliga\u021biilor privind \u00eentocmirea \u0219i p\u0103strarea dosarului personal al salariatului este esen\u021bial\u0103 pentru asigurarea conformit\u0103\u021bii legale a angajatorului \u0219i protejarea drepturilor lucr\u0103torilor. Lipsa acestor documente, \u00eent\u00e2rzierea \u00een eliberarea lor sau ne\u00eendeplinirea corespunz\u0103toare a acestor obliga\u021bii pot atrage r\u0103spunderea contraven\u021bional\u0103 \u0219i prejudicii at\u00e2t pentru angajator, c\u00e2t \u0219i pentru salariat.<\/p><p><strong>Pentru a evita eventuale sanc\u021biuni \u0219i pentru a v\u0103 asigura c\u0103 procedurile interne respect\u0103 cerin\u021bele legale, este recomandat s\u0103 apela\u021bi la un avocat specializat \u00een dreptul muncii, care v\u0103 poate oferi consultan\u021b\u0103 adaptat\u0103 particularit\u0103\u021bilor activit\u0103\u021bii
