Romanian legislation provides several types of leave and allowances to support insured individuals when their health condition no longer allows them to carry out their work under normal conditions, or when the prevention of illness and restoration of work capacity is required.
- Allowance for Reduced Working Time
If, for medical reasons, you can no longer work full-time, the law allows reducing your schedule by one quarter of the normal duration.
Who can benefit: insured persons who, for health reasons, cannot perform the normal working hours.
Duration: up to 90 days within the last 12 months, in one or several stages.
How it is granted: upon recommendation of the attending physician, with the approval of the social insurance medical expert.
Allowance amount: the difference between the calculation base and the gross salary earned after reducing the schedule, but no more than 25% of the calculation base (the average of the gross monthly income in the last 6 months out of the 12 months used to establish the insurance contribution period, up to a maximum of 12 national gross minimum wages per month, based on which the work insurance contribution is calculated).
- Quarantine Leave and Allowance
Insured persons may benefit from leave and allowance if they are placed in quarantine or isolation, according to Law no. 136/2020.
Certificate issued by: the attending physician or the family doctor, depending on the case.
Duration: established depending on the progression of the illness and monitoring period.
Allowance amount: 100% of the calculation base, fully covered from the budget of the National Health Insurance Fund.
Exception: if quarantine is imposed upon returning to the country after personal travel to an epidemiological risk area, the allowance is granted for only 5 days.
- Spa Treatment and Recovery
If you are temporarily unable to work for more than 90 consecutive days, you may benefit from spa treatment and recovery, based on an individual program prepared by a specialist doctor and approved by the social insurance medical expert.
Duration: 15–21 days, depending on the illness.
Where it takes place: in specialized medical units contracted with the health insurance funds.
Obligations: compliance with the individual program is mandatory; failure to comply may result in losing the right to the allowance.
Conclusion
These types of leave and allowances are designed to protect your health and support your return to work under optimal conditions. However, the procedure involves specific medical documents and approvals, and uncertainties can delay the granting of rights. To ensure that you meet all conditions and benefit from the legal support available, it is recommended to consult a lawyer or a specialist in labor and social security law.
