
If you have been a victim of a car accident caused by a third party's fault, you are entitled to full compensation for the damage suffered. The responsibility for covering the damage falls on the insurance company with which the liable third party has a motor third-party liability insurance (MTPL) contract. The insurer is obligated to provide monetary compensation for the following types of damages:
- bodily injury or death, including non-pecuniary damages;
- material damages, including costs for deregistration and registration, stamp duty costs, costs for mitigating the damage, proven by documents, costs related to the reduction in the vehicle’s value after repairs, proven by documents or expertise;
- costs related to restoring the vehicle to its pre-accident condition, proven by documents issued through specialized systems or documents issued under legal conditions;
- damages representing the consequence of the inability to use the damaged vehicle, including the temporary replacement of the vehicle, based on the choice of the injured party;
- legal expenses incurred by the injured party or related expenses in case of alternative dispute resolution if the solution is favorable to the injured party;
- costs related to the transportation of the damaged vehicle, belonging to the injured third party, from the accident location to the damage assessment center or to the repair unit chosen by the injured party, whichever is closest to the accident location or the residence of the injured party, as the case may be, if the vehicle can no longer be moved by its own means and the insurer does not provide transportation.
The amount of compensation awarded must cover the entire damage suffered without exceeding the maximum liability limit of the MTPL insurer (the higher value between the liability limit stipulated in the applicable legislation and that provided in the MTPL contract).
In case of bodily injury or death, compensation:
- Is granted both for persons outside the vehicle that caused the accident and for persons inside that vehicle, except for the driver of the vehicle at fault for the accident.
- Is also granted for damages caused to the spouse or persons dependent on the owner or driver of the insured vehicle.
- Is granted if the vehicle that caused the accident is identified and insured, even if the perpetrator of the accident remains unidentified.
