Free movement and residence of EU member state citizens within the territory of Romania

First and foremost, it should be noted that according to current Romanian legislation, citizens of EU member states, as well as those of the European Economic Area (EEA) and not least citizens of the Swiss Confederation, enjoy the same legal regime regarding entry and establishment of residence on the territory of Romania.

Furthermore, it should be mentioned that family members of EU member state citizens also benefit from a special, favorable regime, even if they themselves are not citizens of an EU member state.

Thus, for entry into Romania, EU citizens are required to present at border checkpoints either a national identity document or a passport, without the application of an entry stamp by border police on any of these documents.

For family members who are not EU citizens, there is an obligation to obtain an entry visa, which is granted without payment of consular fees, in the shortest possible time and based on an expedited procedure.

If the following cumulative conditions are met, family members who are not EU citizens will be exempt from the obligation to obtain an entry visa:

  • accompanying a Union citizen or joining a Union citizen exercising their right of residence on the territory of Romania;
  • holding a valid document attesting to residence in another member state as a family member of the Union citizen they accompany or join in Romania.

Once in Romania, EU citizens are entitled to reside for a period of up to 3 months from the date of entry into the country, without meeting any additional conditions, or even up to 6 months if they are seeking employment.

After exceeding the period of 3 months, respectively 6 months, citizens of EU member states are required to register their residence with the competent territorial unit of the Romanian Immigration Office and apply for the issuance of a Registration Certificate.

Only EU citizens who meet one of the following situations can apply for a Registration Certificate:

  1. have worker status;
  2. have means of support for themselves and their family members, usually at least at the level of the guaranteed minimum income in Romania, and health insurance;
  3. are enrolled in an accredited institution in Romania under the law, primarily engaged in educational or vocational training activities, have health insurance, and provide the competent authorities, through a statement of liability or by any other means, that they have means of support for themselves and their family members, usually at least at the level of the guaranteed minimum income in Romania;
  4. are family members of a Union citizen who meets one of the conditions mentioned in points 1-3 or of a Romanian citizen with domicile or residence in Romania.

For each of the above situations, the EU citizen must submit to the Romanian Immigration Office certain supporting documents, such as: an individual employment contract, civil status documents, bank statements, health insurance proof, certificate from the educational institution where enrolled, etc. To identify exactly the necessary documents based on your personal situation, it is recommended to consult with a specialized lawyer who can guide you throughout the procedure.
